Balancing Privacy and Accountability:The ACLU's Push for Discretionary Body Camera Recording

In recent times, there's been a marked shift in the dialogue around policing and law enforcement practices. A critical part of this conversation is centered on the usage of body-worn cameras (BWCs) by officers. As a civil liberties organization, the American Civil Liberties Union (ACLU) has been at the forefront of this discussion, arguing that while BWCs provide several benefits, they need to be tempered with considerations for individual privacy. The ACLU now calls for discretionary recording within the use of body cameras.

It's worthy to note that the adoption of BWCs by law enforcement agencies has largely been motivated by accountability factors. BWC footage has incontrovertibly shifted the narrative in many instances where excessive force was employed, adding a layer of transparency that has been previously lacking in these critical encounters. Moreover, BWC footage can serve a crucial role in the investigations and judicial processing through providing evidence for legal cases.

However, alongside these undeniable benefits, there are undeniable concerns related to individual privacy. As the ACLU rightly points out merely drawing a circle around highly sensitive areas such as homes and private settings does not sufficiently address these concerns. For instance, someone under the cloud of an investigation could have their everyday lives and mundane activities recorded and stored for posterity.

The ACLU proposes a balance - a measured approach of discretionary recording. By this standard, officers will be encouraged to use their discretion about when to record and when not to, particularly in instances that are unlikely to result in an enforcement action. Essentially, the policy will apply the "Goldilocks principle" - not too little, not too much, but just the right amount of recording to ensure accountability without unnecessary invasion into private lives.

This move by the ACLU may seem like a significant departure from its previous hard-line stance, where the organization was strongly advocating for constant recording. However, it is more of an evolution than a departure, reflecting the complexities of real-life policing and law enforcement.

Implementing discretionary recording will require additional considerations. How do we ensure that the discretion exerted by the law enforcement officers will be fair and unbiased? How do we prevent abuses of such discretion? How reliable can the discretion of an individual officer be?

One possible way to operationalize discretionary recording is to provide a clear list of scenarios, both in terms of specific types of interactions and potentially sensitive locations, where recording should be assumed. Still, given the infinite variety of human interaction and the unpredictability of policing, it will be impossible to foresee all possible circumstances.

So, the only feasible way to ensure the system is just and fair is to combine these general guidelines with extensive training about the rationale behind the limits. Greater attention must then be paid to supervision and audits, as well as disciplinary action against violations.

What the ACLU is advocating for isn't a perfect solution—it's a modification meant to safeguard individual privacy while still ensuring accountability. This push shouldn't be seen as a final statement but rather an ongoing discussion that will require continuous revisiting as technology evolves and society changes.

In the end, it's all about striking a balance. An equilibrium that respects individual privacy but doesn't forsake societal safety. Where law enforcement can be held accountable, yet still perform their crucial role without the fear of unreasoned judgement. And in this ambitious but necessary pursuit of balance, the ACLU's call for discretionary recording for body cameras promises to be an essential piece of the puzzle.
